Justification of theory Essay

When talking to Matthew it is essential the teacher makes him feel comfortable, the teacher does this by talking in a clear but soft voice but also being careful that its not just Matthew that she talks to like this as this could single him out from other students. Verbal communication can say a lot about how your trying to speak to the client, as the pitch and tone can create atmosphere when speaking. It is important to speak in a soft voice to Matthew as when shouting or telling him of in a loud voice this makes him aggressive and he can become violent as this would upset and make him feel uncomfortable. Non-Verbal Communication: non-verbal communication can mean many thing suck as moving hands when you speak, posture, how you sit or even facial expressions. Non-verbal communication is very important in any interaction. When interacting with Matthew he likes to be made to feel at ease. To do this the teacher should sit in an open posture with no objects blocking communication, also slightly leaning towards him being careful not to invade his personal space and keeping good eye contact at all times. Matthew’s teacher does not alas do this as when he is being aggressive she ignores him and does not keep any eyes contact, this makes Matthew more aggressive as he is trying to gain the teacher attention by being aggressive and disruptive so therefore his behaviour worsens. Facial expression also helps the interaction, as positive expressions such as smiling when Matthew is talking make him feel the teacher is interested in what he is saying so therefore may contribute to class discussions more in the future. Prompts can also be very helpful as when Matthew is uncomfortable speaking such prompts as ‘carry on’ or ‘that’s right’ may give him confidence when he is speaking. Outcome of Patterns: When all of the above have been taken into consideration a successful interaction will come of it. The above ways are how Matthew likes to be communicated with, as this way is the most effective as it does cause aggression. Overall Matthew has shown less aggression in the class and is interacting appropriately with his teacher and other student around him. Attachment/Separation theory 2. Berkowitiz. Aggression theory How theories relate to specific behaviour The first theory Bowlby’s maternal deprivation relates to Matthew as he is the oldest of four children and his father left when he was only seven, since then he has lived with his mother and has been the only male in the house. In studies using the strange situation Bowlby found that infants maybe securely attached to one parent but not the other or in securely attached to both. Bowlby also agrees that man are capable of providing adequate parenting and becoming attachment figures for there young children, and the ‘mother does not even have to be female’. Bowlby’s separation theory relates to Matthew as his parents divorced when he was seven and since then he has had no contact with him. Bowlby calls separation anxiety, namely the fear tat separation will occur again in the future. This can result in aggressive behaviour and greater demands towards the mother, which has been shown by Matthew in the case study. It’s also shown that the consequences of divorce are more serious and damaging then those following the death of a father. Which is why children who commonly experiencing parental divorce show separation anxiety, and they may begin to question the security of their remaining relationship, since if the father can leave, why not the mother too? Children usually deeply resent their parents separation and may retain fantasies of reunion for many years to come. They experience separation as a course that has been chosen by the parents in the knowledge that they do not want it. This especially applies to Matthew as he resents he mother for his father leaving. This makes children feel powerless, disregarded and angry. Where as Matthew has become very aggressive towards his mother because of his father leaving. Divorce has a far greater negative effect on the child’s school work then the death of a parent. As a result of these factors, the relationship between the child and the custodial parent is bound to suffer. Mothers become more authoritarian, increasing the number of demands and restrictions and becoming less affectionate. The children (especially boys) become more aggressive and inflexible. Berkowits aggression relates to Matthew as he has show violence towards his mother, which his father display to his mother in front of him before he left. Berkowits describes aggression as ‘behaviour which is physical or symbolic, that is carried out with the intention to harm someone’. He reserves the term violence for an extreme form of aggression, a deliberate attempt to do serious injury. Freud sees aggression as instinctive, with aggression energy needing to be released regularly if it is not to built up to dangerous levels. The frustration-aggression hypothesis see instinctive and learned reactions as involved, while the social learning approach deindividuation emphasize cognitive aspects of learning from others behaviour and the influence of others on the individual behaviour respectively. Berkowits aggressive-cue theory is bases on the fact that aggressive or violent behaviour is at least partly a reaction to specific features of the surrounding situation which ‘pull out’ responses that heighten the strength of the behaviour. This happens when the aggressive meaning for the aggressor and or when they some how remind the aggressor of decidedly unpleasant experiences; this is the aggressive-cue theory. This theory will relate to Matthew as when he’s reminded of his fathers aggressive behaviour towards his mother he then becomes aggressive himself and uses violence in the same way as his father. Justification of theory: I chose to apply these theories because it supports the behaviour that I am applying them to. As the case study shows aggression and separation the two theories will explain why such thing as aggression is caused and will also back up my work. E3. Any Kind Checks Cashed, Inc. v. Talcott Essay

According to the UCC, a holder in due course is a holder who takes an instrument for value in good faith and devoid of notice of assured claims, as well as defenses on the instrument. It is imperative in the case of ‘Any Kind Checks Cashed, Inc. v. Talcott’ to determine if the holder of the instrument acted in good faith, in fair dealing as is compulsory in order to be considered the holder in due course. According to the Commercial Law Article 3-103 (a) (4); good faith refers to sincerity or honesty in fact and the adherence to logical commercial standards of fair dealing (Twomey, D., & Jennings, M.). Apart from this, the court upholds the trial court finding that Any Kind did not act in good faith when cashing a check for $10,000. However, Any Kind had been in good faith in later on cashing one more check for $5,700. I agree that ‘Talcott’ was responsible for the $5,700 even despite the fact that he was illegally persuaded to issue a check (Legale .com). The procedures in place at Any Kind Checks Cashed, Inc.states that a supervisor that has the power as well as authority to approve checks over $2,000. However, the supervisor should have been more cautious due to the unusual amount of the check of $10,00.00. When the second check of $5,700.00 was presented the check cashing company had been in contact with Talcott getting his verbal approval for cashing a check. As a result, Any Kind Check Cashed Inc. satisfied the good faith prerequisites for a holder in due course. In reviewing if, the tellers actions where in accordance with good faith and acted reasonable within the commercial standards for accepting and processing the check. The fact is that the clerk did take action and question the intent of the check of $10,000.00 by calling the maker of the check Mr. Talcott, but was not able to reach him. As a result  of not reaching Mr. Talcott the, the supervisor relied on her judgment and experience to make her decision to cash the check. Using her judgment coupled with appeared to be evidence the FedEx envelope showing that the FedEx was sent from Mr. Talcott the supervisor was acting in good faith but not in accordance with a the reasonable commercial code. There should have been some level of suspicion that someone would pay a 500.00 fee to cash a check and not go to his or her bank and collect the full amount of the 10,000.00. To a reasonable person this type of behaviour may raise a red flag as to the desperation of the person (payee) to cash such a large check. The check cashing store should have verified with the issuing bank to ensure that there was enough monies in the account to cover the check and verify that the check is good (no stop payment was issued). When Mr. Guarino presented a second check to the check cashing store for $5,700.00, the store reached out and spoke with Mr. Talcott asking him to verify the check for $5,700.00, which he verified. The check cashing store never mentioned the first check of $10,000.00. Perhaps they presumed that since Mr, Talcott approved the second check that and never said anything about the first one being of issue it may have seemed as a nonissue. If Any Kind processed the $10,000 check with proper caution and procedures beyond making a phone call and not getting an answer from the maker of the check. Any Kind should have contacted the bank the check was drawn on to verify that there was no issue with the check and not rely on experience and a FedEx cover. In order to ensure that they and preserved their status of the holder in due course status. The courts determined that Any Kind was not the holder in due course due to the manner in which they did not ensure that the check was valid before cashing and processing it. I agree with the court’s decision in finding that Any Kind is not the HDC for the $10,000.00 since they were really negligent in the handling and processing of the check. I agree, with the court’s ruling in favour that Any Kind is the HDC for the $5,700.0. Since ‘Any Kind’handled the process in good faith and within accordance with reasonable commercial standards according to the UCC 3-419[3] (Legale .com). Marketing is more than selling and promotion Essay

The primary concern or objective of marketing is to identify and satisfy, or exceed the changing needs of customers. In view of this broad concern of marketing, it can be seen that the concept of marketing summarizes many activities in a business. Marketing, in fact, refers to any activity undertaken by a firm that has been designed to plan, price, promote and distribute ideas, goods and services to target markets. These marketing activities were executed in order to create an exchange and sales that will result in the achievement of the proprietors’ individual goals and the firm’s goals, both in the short-term and the long-term. It is then obvious that marketing forms an integral component of any business’s operations. In particular marketing activities attempt to increase a firms’ revenue base, by showing the importance of attracting potential customers in target markets to purchase the firms’ products in order to satisfy their wants, rather than those of firm’s competitors. Consequently, the marketing directly contributes to the attainment of the financial goals of the firm. Hence, the success of a firm is reliant upon the extent to which it is able to identify, and satisfy the customer’s needs more effectively. Marketing as an activity that involves several features, all of which are presented during the course of the marketing process. Such features include, firstly and most importantly, that marketing is a long process that begins with the creation of an idea and ends up as product that will be sold to satisfy a customer’s needs. Secondly, marketing is seen as a managerial process as it involves making managerial decisions about the particular mix of product, price, place and promotion in a firm. Furthermore, marketing involves managers planning and ensuring that particular arranged activities are carried out, in order for the marketing plan to be successful. Finally, marketing is perceived as a way in which firms are able to satisfy the needs of customers, and in turn achieve their own business goals. Marketing provides the business with the ability to satisfy the changing wants of customers. In light of this, and the fact that businesses have  become increasingly aware of the role that marketing plays in achieving success in the business, several approaches or philosophies to marketing have developed. There are different approaches to marketing, to help to define marketing and to show, how a specific marketing approach/s depends upon particular business’s marketing strategy and the type of product being marketed. Starting with a Marketing Concept, which believes that a customer’s need for satisfaction, is the economic and social reason for an organisation’s existence. This approach requires, that all of the business’s activities should be targeted towards meeting consumer wants, while at the same time meeting the organisation’s goals. In effect, this approach needs the firm to find out what the customer wants, and subsequently develops a product to meet these requirements and then sell it at a profit. Then the Production Concept should be considered. This approach states that the business will sell its product if it is both well made and affordable. Businesses utilising this method require management to focus on improving production techniques and cost structures of the business The Product Concept focuses on the quality, features, and performance of the product. Believing that if the product has more features or is of a better quality and performance compared to competitors, it will then gain greater sales it is defiantly less customer orientated. The Selling Concept concentrates on developing sales techniques and promotional activities in order to entice customers into buying an organisation’s product, whether they want it or not. Therefore this approach places direct emphasis on customers, but possibly not on their want-satisfaction. After all the Societal Marketing Concept which is the latest marketing approach, combines the main ideas of the marketing approach, that is, determining customer needs and satisfying the business’s goals, but also integrates social responsibility into the business. This social responsibility includes increasing environmental awareness, which may include tackling the problems of pollution and the exploitation of  non-renewable resources. Modern day businesses are under pressure to adopt this marketing approach, in order to become more socially responsible. This approach not only focuses on fulfilling the customer’s want-satisfaction, but also satisfying society. These four approaches in particular show, that marketing is more than promoting and selling a product. They could be compared with the four P?s (product, place, promotion and price), which are normally used to describe the process of marketing. But the concepts of marketing, production, product, selling and society marketing give another view into the difficult and never ending process of marketing.

The advantages and the disadvantages of being female. Today ,be female could be advantageous yet could command some disadvantages ranging from the way one thinks , talk , the way people appreciate and consider you . The pains one may feel physically , spiritually and emotionally. Being female in a world which is continuously changing and demanding could be very difficult at times and very easy in some cases . The advantage of being female includes a lot of things. Females have a wonderful self support system .There are a number of things female do to pick them selves up again that men don ‘t have the privilege of doing. Also exists a number of pampering techniques that women use in putting themselves back together especially those who like to be spoilt could simply pick themselves up again by making a call to several close friends who will be at the door fully armed with sympathy , chocolate and even more quicker than you say so what your evening like. Women are more tuned to e motions than men and find it easier to express themselves .While most men wouldn ‘t be caught dead crying in public , let alone in front of their partners. Women will find a number reasons to burst into tears be it out of frustrations or for emotional reasons . But one aspect of crying men haven ‘t discovered or mastered is that in an argumentative situation , it can be used as a tool to get your way out or to prove a point but case that all effect fails try turning out the water works. A definite advantage of been female is the option to wear make up which really comes in handy.When you are having an off day ,Make up can serve two purposes:It can enhance a woman ‘s natural beauty or it can disguise those occasional flaws in the skin or the after effects of last nights partying. Women unfortunately have to suffer and endure the uncomfortable and often painful experience of having periods and with that ,there are associated emotions and mood swings . A clear disadva ntage over males some may say,but I think it could be also perceived as an advantage. Women unlike men have an excuse to be cranky,unreasonable or even impossible at times an occasionally they milk it for its worth.Just by being female she automatically has a reason for being irritable. Disadvantages are too numerous,frequently you hear men say it ‘s a mans world ‘ really it is a world dominated by men. Even when women get married the men seem to dominate all activities of the family. Even in the larger society men dominate in working sectors and so on. Most frequently women are sexually blackmailed for favors especially for employment purposes. While the men never receive such harassments. Despite the appearances that women are gaining in their options, their status has remained unchanged.This is because society still clings to traditional conventions in which women are supposed to stay inside the home. Furthermore, young women are expected to maintain harmony among the ir group at home or in the office by suppressing their individual personalities. To get out of this setup is difficult because daily life is so deeply immersed in such conventions. Eating would have been easier if the patient could have been able to sit out of bed, but this was next to impossible in this case, since he was bedfast and had no balance to maintain a straight posture. As a result, support was arranged to make him sit upright on the bed, and a suitable table was arranged and placed in front of him where the food and drink can be kept.
